  Terms and Conditions for new Entrants/Applicants
1. The applicant is required to read thoroughly and understand the terms and conditions, policies, procedures and compensation opportunities of the Trust as given below. This application/agreement form is considered as an authentic and legally binding document. This contract is between the applicant (herein after referred to as distributor) and SARVA SAKSHARTA PRASAR ABHIYAN TRUST (hereinafter referred to as Trust).

2. If the applicant agrees to adhere to and abide by the conditions mentioned hereunder, he/she shall become a distributor on payment of the prescribed distributorship fee to the Trust by way of a crossed demand draft.

3. The applicant should have completed minimum 18 years of age and shall be competent to enter into contract as provided in the Indian Contract Act.

4. For joining as an independent distributor of the Trust, the applicant will have to make the prescribed payment towards distributorship fee by way of a crossed demand draft favouring SARVA SAKSHARTA PRASAR ABHIYAN TRUST.

5. If the applicant is a Partnership firm/Private limited Trust, then the applicant has to provide all necessary documents pertaining to the partnership during the registration of Distributorship.

6. While placing orders for any of the products available with the Trust, he/she will have to pay the cost of the product by way of crossed demand drafts favouring SARVA SAKSHARTA PRASAR ABHIYAN TRUST.

7. The Trust under no circumstances will accept any payment in cash.

8. The Trust has not authorised any official, officer or distributor of the Trust to receive any amount in cash on behalf of the Trust towards the distributorship fee, or cost of products, as the case may be.

9. If anybody makes any payment in cash, it will be at his/her own risk and under no circumstances, will the Trust be answerable to such unauthorised cash payments.

10. The initial payment made by the applicant is towards enrolling as an independent distributor and the same is not refundable under any circumstances. All the packages include the registration fee, the processing fee and the administrative costs.

11. The distributor will be eligible for compensation/ remuneration (incentives) only as per the volume of business done by him that is also subject to the eligibility norms formulated by the Trust. The Trust does not assure any compensation (incentive) to the distributor on merely account of his/her joining the Trust.

12. The independent distributor will not be a consumer, agent, or employee of the Trust. His/her position being so, he/she cannot bind the Trust, in any manner nor he/she has any authority to bind the Trust or to represent or speak on behalf of the Trust.

13. The Trust will approve the distributorship by issuing an official receipt and an online registration, which will carry the password and an identification number known as ID as chosen by the applicant himself/herself. This password and ID have to be quoted by the distributor in all his/her transactions and correspondence with the Trust. The ID once chosen cannot be altered at any later point of time.

14. The Trust will, in no case, entertain any communication without ID and password.

15. The Trust will not entertain any request for any product/package made after six months of the date of acknowledgement of payment.

16. The distributor has to pay annual renewal fees at the end of 12 months of their distributorships as per the Trust norms.

17. Trimming and Service Charges will be deducted as per Trust norms. TDS will be deducted as formulated by the Government.

18. In case of Partnership distributorship/ Distributorship in name of a firm, the private limited Trust distributors have to submit all relevant Partnership deeds and the relevant MOU.

19. All individual distributors should adhere to Rules & Regulations formed by the organization & if any of the distributors is found guilty of not observing the same, then he/she will be terminated from the Trust.

20. The Trust reserves all rights to terminate a distributor.

21. Once a distributor is terminated, he/she cannot enter any of the SSPA TRUST premises/meeting locations and his/her incentives/income will be stopped immediately.

22. The distributor shall bear true faith and allegiance to the Trust and shall uphold the integrity and decorum of the Trust and shall maintain good relations with other distributors and other clients.

23. The distributor shall always behave and act in a dignified manner befitting the status of a distributor of a reputed and leading Trust of the country.

24. The distributor shall not compel or induce or mislead any person with any false statement/promise to join the Trust or to purchase any product.

25. The Trust will not be answerable for any promise, assurance given by any distributor to any person, unless it is in accordance with the approved business plans and terms of the Trust. Hence, the applicant shall go through the website-"www.mytejas.com and the brochures and notices issued by the Trust. Through these Trust sources, he/she will fully inform himself/herself on all these matters.

26. The applicant/distributor shall ensure that all the information/furnished to the Trust is correct and properly entered. Any request for correction furnished by the distributor as to his/her sponsor or placement details will not be entertained, once payment statements are processed.

27. The Trust reserves the right to reject any distributorship/application at its own discretion.

28. The Trust reserves the right to modify the terms and conditions, products, schemes, business and policies, giving prior notice through its website – www.mytejas.com and it will be binding on all distributors of the Trust.

29. The terms and conditions within above mentioned shall be governed in accordance with the Law in force in the territories of India. Disputes, if any arise, shall be subject to the exclusive jurisdiction of the Court of Meerut.

30. If any dispute or difference arises between the parties hereto touching the business or interpretation of any terms and conditions or as to incentives, income etc., relating to the business of the Trust, the same shall be referred to arbitration and the arbitration shall be governed by the Arbitration And Conciliation Act, 1996.
  Distributor Duties & Responsibilities:
1. A distributor is an independent business entity. Hence, he/she is not an employee, agent or representative of the Trust.

2. A distributor shall not use Trust name, logo, slogan, trademarks, and trade names without the Trust's consent.

3. Distributors shall not engage or participate in any other networking or direct-selling companies. If found, such distributor will be terminated with immediate effect without notice.

4. No distributor or leader shall conduct unauthorized seminars, meetings or assembly that is not in line with the business ethics of the Trust. Any leader or distributor found to have been engaged in discriminating or inducing others to complain against the Trust's procedures, rules and regulations will be terminated with immediate effect without notice.
  Transfer of distributorship:
1. Application for change of sponsor or for the transfer of personal/group sales is prohibited.

2. Application for change of Name can be entertained provided the applicant shall abide the following Name Transfer Clause:

(i) The Name Transfer application (NTA) should be dully filled along with “No Objection Certificate” (NOC) typed in a Stamp Paper (Rs.20 ) from the existing distributor & attested by the sponsor as well as by up line/super up line and the original should be sent to the Trust.

(ii) Applicant should pay Rs.1000/= along with the NTA & NOC. The application will be processed only on receipt of original NTA & NOC.

(iii) In case of name transfer among blood relations (spouse, children, parents & grandparents), no deduction are enforced for such transfer other than the NTA charges.

(iv) The Trust reserves the rights to accept or reject the NTA upon proper evaluation.
  Termination Of Distributorship:
1. All distributors, stockiest and state stockiest should adhere to Rules & Regulations and Code of Ethics of the Trust & if anyone is found guilty of not observing the same, then he/she will be terminated from the Trust with immediate effect.

2. The Trust reserves all rights to terminate a distributor. Once a distributor is terminated, he/she cannot enter any of the Trust premises/meeting locations and his/her incentives/income will be stopped immediately.
  Death & Inheritance:
1. In the event of the death of the distributor, the valid distributorship*(distributorship renewable for every 12 months) shall be reserved to the legal heirs of the deceased distributor.

2. The legal heir/s shall submit a certified copy of legal heir certificate to the Trust stating their request to replace the deceased distributor. The Trust has the right to approve/disapprove the request upon proper evaluation.
  Prohibited Business Practices:
1. Under-cutting: Selling the Trust products in the market at a discounted price below the prescribed price rate is strictly prohibited.

2. Cross Sponsoring: Re-registration under other sponsor/up line in the same name or different name is strictly prohibited.

3. Convincing, Enticing or Inviting co-distributor to join other MLM/ Direct Selling Company/ Trust is strictly prohibited.

4. Dummies/False representative(s): Registration of dummies or false representative(s) is strictly prohibited. The Trust reserves the right to terminate such distributor found guilty for committing above such prohibited business practices with immediate effect without any notice. The Trust reserves the right to suspend/cancel any commission or incentive(s) generated through the use of dummies/false representative(s).
  Compensation /Remuneration (Incentives) & Payout:
1. Remuneration (Incentives) are based on the performance of the distributor as per the compensation plan.

2. All the club remuneration (Incentives) will be paid according to monthly growth of plan and it will be paid at 10th of every month.

3. Remuneration (incentives) will be paid through bank account transfer as per the information provided by the distributor. The Trust will not be responsible for any delay or loss due to the wrong or incorrect bank details provided by the distributor.

4. If the distributor could not provide complete and correct bank details, the accrued commissions (incentives) will not transferred and it will be on hold with the Trust. Any such commissions hold by the Trust for more than three months will be forfeited automatically. No distributor can claim after such forfeiture.

5. Commission statements are system generated & it can be downloaded or printed from the distributor login of the Trust website.

6. The Trust always reserves the rights to hold and cancel the distributor /stockiest/ state stockiest commission (incentives) if found guilty for committing any breach of Trust rules & regulations and code of ethics.

7. The Trust always reserves the rights to hold and adjust the distributor / stockiest/ state stockiest commission (incentives) against any receivables from such distributor/stockiest/state stockiest to the Trust.

8. The distributor can generate joining/product PIN from his/her e-wallet. Doing this the distributor can earn 2.5% income on PIN Generation.
  Legal & Taxations:
1. The rules & regulations mentioned above shall be governed in accordance with the Law in force in the territories of India. Disputes, if any arise, shall be subject to the exclusive jurisdiction of the Court of Meerut.

2. If any dispute or difference arises between the parties hereto touching the business or interpretation of any terms and conditions or as to incentives, income etc., relating to the business of the Trust, the same shall be referred to arbitration and the arbitration shall be governed by the ‘Arbitration and Conciliation Act, 1996’.

3. The Trust reserves the right to modify/ change the business plan and policies, giving seven days prior notice through its website - “www.mytejas.com” and it will be binding on all distributors of the Trust.

4. All taxes and fees that may be required by the government are to be shouldered by the distributor only.

5. Admin charges & Pair balance deduction (trimming) will be applicable as per the Trust norms. TDS will be deducted as per the Income Tax Act.
